Michael Notoriano - St. Clair Shores police sergeant convicted of Willful Neglect of Duty (one-year misdemeanor) was sentenced today to six months in Wayne County Jail by Judge Timothy Kenny.

Warren Man Charged in Violent Assault of Grosse Pointe Farms Designer Daniel Clancy
Prosecutor Kym L. Worthy has charged David Scott Corzilius, 49 (DOB: 12/13/66), of Warren, in connection with the violent knife assault on Daniel Clancy, 69, of Grosse Pointe Farms. On March 6, 2016 at 4:00 p.m., Grosse Pointe Farms police officers responded to a call of a man found on the sidewalk in the 200 block of Voltaire Place. When they arrived, they observed Mr. Clancy bleeding heavily from his neck. He was transported to a local hospital where he continues to be treated for multiple knife wounds. In the house, blood was observed and there were signs of a struggle. Items of personal property, including some valuable paintings owned by Mr. Clancy, were reported missing.
On March 6, 2016 before 4:00 p.m., it is alleged that Corzilius demanded money, hit Clancy in the face and bound his hands with duct tape. Corzilius slashed Clancy's neck with a knife, stole property from his home and drove away from the location with the stolen property in his truck. The defendant had been hired as a handyman to clean gutters and remove snow from Mr. Clancy's home. Investigation by the Grosse Pointe Farms Police Department resulted in the identification and arrest of Corzilius.
The defendant has been charged with Assault with Intent to Murder, Assault with Intent to do Great Bodily Harm, Felonious Assault, Armed Robbery, Home Invasion First Degree, Unlawful Imprisonment and Larceny in a Building.
Prosecutor Worthy said: "It was pretty clear to those in law enforcement that this brutally violent assault was not random, but the work of someone who knew Mr. Clancy. The alleged actions of the defendant bear this out."
Corzilius was arraigned in Grosse Pointe Farms District Court before Judge Matthew R. Rumora at 5:00 p.m. He received a one million dollar cash/surety bond and the Probable Cause Hearing is on March 23, 2016, 8:00 a.m. and the Preliminary Examination will be held on March 30, 2016 at 8:00 a.m.

Three Charged in Death of Detroit Firefighter David Madrigal
Today Prosecutor Kym L. Worthy has charged three defendants in connection with the homicide of Detroit Firefighter David Madrigal, 59, of Detroit. On the evening of December 19, 2015, it is alleged that Timmy Lynn Soto,32 (11/3/83), of Detroit, Nicole Oneill, 33 (5/19/82), of Detroit, and Christian Rasnick, 19 (7/15/96), of Trenton, went to the victim's home on Vaughan Street and robbed, killed, and stole personal property from the victim. It is also alleged that the victim's vehicle was driven to an alley near the 3800 block of Bangor by Defendants Soto and Rasnick was set on fire. The car was discovered on December 19, 2015 at approximately 6:56 p.m. on Bangor when the Detroit Fire Department responded to the fire.
On December 21, 2015, at approximately 7:30 p.m. the Detroit Police Department responded to a call from a relative who went over to check on the victim and discovered his lifeless body. The relative also observed that the house was ransacked. The medical examiner determined that the cause of death was blunt force trauma to the head. The details of the case will be presented in court at the preliminary examination.
Timmy Lynn Soto, Nicole Oneill and Christian Rasnick have each been charged with: Felony Murder; Armed Robbery, Larceny in a Building, and Arson Third Degree. Soto also been charged with Unlawful Driving Away of an Automobile, Felon in Possession of a Firearm, and Felony Firearm. Rasnick has an additional charge of Unlawful Driving Away of an Automobile.
Prosecutor Worthy said, "It is very sad that a 26-year veteran of the Detroit Fire Department was murdered. We are glad to report that because of the tireless work of DPD homicide officers we are able to issue charges today."
The defendants were arraigned on Friday and were remanded to jail. Their Probable Cause Conference date is 8:30 a.m. March 23, 2016, before Judge Kenneth King. The preliminary examination is currently set for 1:30 pm March 30, 2016, before Judge King.

Virgil Smith Jr. - His sentence hearing was held today before Judge Lawrence Talon who indicated that he would not accept the condition of the plea agreement that Smith must resign his position as a state senator.
The judge gave a new date of March 28, 2016 for the case. On March 21, 2016, the People have been ordered to file a brief with their legal objection to the judge's refusal to accept the condition that the defendant resign his elected position. Prosecutor Kym Worthy said," The plea is legal, and the defendant agreed to it. If all the conditions are not accepted by the court, we will withdraw our plea. We are certain that we stand on solid legal ground."

Mateen Cleaves Charged in Alleged Sexual Assault
Prosecutor Kym Worthy has charged Mateen Cleaves, 39, of Grand Blanc, Michigan in connection with an alleged sexual assault of a 24-year-old Mount Morris, Michigan woman. On September 14, 2015, Cleaves was at a charity golf outing where he was introduced to the complainant, her boyfriend and several co-workers. After the outing, Cleaves and the group went a local bar where they had drinks. On September 15, 2016, at approximately 1:00 a.m., they all left the bar. The complainant's boyfriend gave a friend a ride home. The victim, thinking they would return to the golf club, rode with Cleaves in his car. It is alleged that Cleaves took the complainant to a motel located in the 2400 block of West Grand Blanc, in Mundy Township, held her in a room against her will, and sexually assaulted her. The complainant was able to escape from the room and received assistance from a woman in a nearby room. The case was investigated by the Mundy Township Police Department. Further information about the case will be presented in court at the preliminary examination.
On October 23, 2015, the case was transferred to the Wayne County Prosecutor's Office by the Prosecuting Attorney's Coordinating Counsel. Genesee County Prosecutor David Leyton requested the transfer due to a possible conflict of interest with a potential witness in the case. Wayne County Assistant Prosecutor Lisa Lindsey will prosecute the case in Genesee County.
Today Cleaves has been charged with Unlawful Imprisonment (15-year maximum penalty), Assault with Intent to Commit Criminal Sexual Penetration (10 year maximum penalty), Criminal Sexual Conduct Second Degree (15-year maximum penalty) and two counts of Criminal Sexual Conduct Third Degree (15-years maximum penalty).
Prosecutor Worthy said, "The evidence in this case will show that the alleged actions of this defendant were not only criminal, but arose out of a sense of entitlement sometimes found in prominent people."
The arraignment on the warrant will not take place today. Arrangements are being made for Cleaves to turn himself for processing and arraigned in 67th District Court in Genesee County on March 17, 2016 at 9:00 a.m.

Mateen Cleaves to be Arraigned in Alleged Sexual Assault This Morning
The Wayne County Prosecutor's Office has just been informed that instead of arraigning Cleaves tomorrow at 9:00 a.m. that 67th District Court Judge M. Kathy Dowd is allowing the defendant to be arraigned this morning. WCPO asked that the arraignment take place on March 17, 2016 at 9:00 a.m., but the court has decided to go forward with the arraignment this morning.

The Wayne County Prosecutor's Office was informed with short notice that instead of arraigning Cleaves tomorrow at 9:00 a.m., that 67th District Court Judge M. Kathy Dowd allowed the defendant to be arraigned this morning. WCPO had the officer in charge of the case contact the defense attorney yesterday to inform him of the arraignment date and time. This morning, WCPO requested that the arraignment take place on March 17, 2016 at 9:00 a.m., but the court has decided to go forward with the arraignment this morning. The defendant has received a $150,000 personal bond, and will have his probable cause hearing on March 29, 2016 at 8:30 a.m. The preliminary examination is scheduled for April 5, 2016 at 8:30 a.m. before Judge Dowd.
Prosecutor Worthy said," I don't know how they do things in Genesee County but we try our best to be as transparent as possible when my office is involved. We do not approve of secret proceedings unless it is proscribed by law. There was an agreement with all of the parties that the defendant would turn himself in and be arraigned in open court tomorrow - not for him to have a back door arraignment. The public has a right to know and, frankly, I am extremely disappointed that this was handled so clandestinely today. I hope this is not a precursor of things to come."

Daraian Winfield - Charged in the homicide of a 17-year-old Detroit woman. The homicide case will go first in time for trial. The following dates apply to all cases: April 15, 2016 at 9:00 a.m. for a pretrial conference on the homicide and a final conference for the Home Invasion case and the CSC Second Degree case.

Marcus Glenn - Defendant charged in the fatal car crash that occurred at W. Jefferson and Griswold in downtown Detroit. The preliminary examination was held and the defendant was bound over on Operating a Motor Vehicle Under the Influence of Alcohol Causing Death (15 years). The arraignment on the information is scheduled for March 31, 2016 at 9:00 a.m.
