No Charges to Issue in Eastern Market Shooting

On March 23, 2018 at approximately 10:20 a.m., a Detroit police officer was on patrol in Eastern Market when he heard a gunshot and went to the area of Fisher Service Drive and Riopelle. When he arrived at the location, he discovered Edward J. Ross, 58, of Detroit, lying face down in the street. A 35-year-old Ypsilanti man was standing nearby and informed the officer that he shot the man and he was arrested. Ross and the man did not know each other. Ross died from a single gunshot wound.

The investigation revealed that Ross was inside a truck stealing boxes of meat with another man. When the 35-year-old man heard a co-worker scream, he pulled out his gun, ran to the truck and observed Ross and another man struggling with his co-worker. Ross moved his hand behind his back as though he was reaching for a weapon and the 35-year-old man shot him. The other man who was taking meat from the truck fled the scene on foot. 911 was called immediately and the 35-year-old man and his co-worker waited for the police.

It has been determined that no charges will issue in the case because the 35-year-old acted in lawful self-defense. He had an honest and reasonable belief that the use of deadly force was necessary to prevent imminent death and/or great bodily harm to himself or another person. For this reason the warrant has been denied.
