Comerica Park Food Handler Test Results are Negative for Communicable Diseases

On September 25, 2018 Prosecutor Kym Worthy charged Jaylon Juwan Kerley, 20 (DOB: 10/18/1997), of Roseville, MI, in connection with spitting on pizza dough he was preparing while working at a concession stand in Comerica Park. On September 21, 2018, it is alleged that Kerley spat on a pizza he was preparing and covered his saliva with pizza sauce. The incident was captured on video and reported to the police by the head of security at Comerica Park. On September 23, 2018, Detroit police officers arrested Kerley. He was terminated from his employment as a result of the incident.

Kerley has been charged with one count of Food Law Violations, MCL 289.5107(2), a four-year felony, and one count of Food Law Violations, MCL 289.5107(1), a 90 day misdemeanor.* On October 3, 2018 the defendant was referred for criminal responsibility. The next court date is the Arraignment on the Information on October 17, 2018 at 9:00 a.m.

The court required the defendant to submit himself for disease testing as a condition of his bond. He was tested on September 27, 2018 at the Macomb County Health Department and has waived his right to privacy regarding the test results. The recently released test results show that the Defendant has tested negative for any sexually transmitted diseases, human immunodeficiency virus (HIV), and any type of Hepatitis.

"The Wayne County Prosecutor's Office has been inundated with phone calls from the public since our announcement of charges in this case - specifically inquiring a whether the defendant has certain infectious diseases. We understand that concern and facilitated the expedited testing of the defendant. He in turn waived his privacy rights for us to release this information," said Prosecutor Worthy.

*The charges are allegations and defendants are presumed innocent until and unless proven guilty.
